Understanding Your Property Title

Responsibilities and liabilities

Key Action

Make sure you understand the definitions and trade-offs of the different titles.

Stepping into the Market

Understanding Property titles is important.

Properties that share walls & roofs, driveways, entrances, or other building areas can involve shared repair responsibilities.

Create a modern, clean flat illustration icon of an apartment building showing multiple units sharing walls, in the same simple visual style as the existing terrace-house icon on this page. Use a minimal architectural symbol, clear geometric shapes, restrained professional colors, and a plain uncluttered background. No text, no labels, no people.

Freehold Fee simple

The dwelling is yours, and you have control over the land and any maintenance.

If you’re looking at Terrace houses, they have a connected roofline and share an internal wall. You must check the title. If it is a Unit Title, this type of property requires agreement from all Units to proceed with repairs.

Unit

Apartments and Building blocks have additional body corporate fees to cover repairs and building maintenance.

Understanding the body corporate dynamics with the owners is important.

A modern flat architectural icon for a property guide: a broad overhead community view of a retirement village with many clearly visible detached single-storey homes, arranged in rows along gently curving paths, with shared lawns and a small central garden. Use clean geometric shapes, muted teal and warm neutral colors, consistent with the page's terrace-house and apartment icons. Plain background, no text, no labels, no people.

Cross-lease

Properties on a cross-lease are single dwellings shared within a parcel of land. This type of Property is very common in NZ, and you may share the driveway and any repair costs.

A modern, clean flat vector icon in the same simple educational style as the existing property-title illustrations: a single modest house beside a well-maintained public park with green grass, a few trees, a walking path, and a small fence or sign subtly indicating leasehold land. Use a friendly professional palette, crisp geometric shapes, minimal detail, no text, no logos, and a square composition.

Leasehold

Leasehold properties mean you don’t own the land, only the dwelling.

A leasehold Property agreement is long-term. However, if you see a leasehold property on the market, check the next renewal period.

In Auckland, several properties around Mission Bay, Cornwall Park, and Mt. Eden are leasehold.

The Strategic Horizon

Invest time researching the types of Property currently on the market.

Most properties will have a title (LINZ and LIM report); check whether the property is freehold, cross-lease, unit title, leasehold, or another arrangement.

Also, check whether the land has specific restrictions under the Te Ture Whenua Māori Act or a memorial noting historical connections, which may create additional risk if you want to build or renovate the Property.

Consider extra fees or funds to cover routine or major repairs.
